What is the McKinney-Vento Act?
The McKinney-Vento Homeless Assistance Act is a federal law created to support the enrollment and education of homeless students. McKinney-Vento is intended to provide unhoused students the same educational opportunities as housed students by removing as many barriers to learning for homeless students as possible.  Are you a student or parent/legal

Who qualifies under the McKinney-Vento Act?
Under the McKinney-Vento Act, the term “homeless children and youths” means individuals who lack a fixed, regular, and adequate nighttime residence - including:
  • Sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason
  • Living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings
  • Living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations;
  • Living in emergency or transitional shelters;
  • Abandoned in hospitals;
  • Awaiting foster care placement;
  • Have a primary night-time residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings;
  • Migratory children who qualify as homeless because they are living in circumstances described in the above clauses
